Notice of Adoption - 6 NYCRR Part 242, CO2 Budget Trading Program; and 6 NYCRR Part 200, General Provisions

Notice of adoption of rules on November 27, 2013, to be effective January 1, 2014, to revise 6 NYCRR Part 242, "CO2 Budget Trading Program" and 6 NYCRR Part 200, "General Provisions." The adoption of Part 242 is intended to implement the updated Regional Greenhouse Gas Initiative Program in New YorkState.

Notice of Availability for Comment - Renewal of State Pollutant Discharge Elimination System (SPDES) Concentrated Animal Feeding Operations (CAFO) General Permit
The New York State Department of Environmental Conservation (NYS DEC) proposes to issue a renewal of SPDES CAFO General Permit GP-0-09-001. Upon issuance, this general permit will be an interim general permit, replacing the expiring permit, GP-0-09-001, which became effective on July 1, 2009, was modified on July 29, 2013 and expires on June 30, 2014. NYS DEC elects to issue an interim general permit, with no changes, in order to devote sufficient time to work with a diverse stakeholder group to consider potential future changes to the ECL CAFO general permit. The general permit (GP-0-14-001) will be effective on July 1, 2014 for a limited time period. The interim general permit will authorize the operation and construction of a CAFO that is defined in the New York Environmental Conservation Law (ECL) §17-0105 (16), Title 6 of the Codes, Rules and Regulations of the State of New York (6 NYCRR), Part 750-1.2(a) and Appendix A of GP-0-14-001. Owners or operators of existing CAFOs with coverage under GP-0-09-001 shall be covered by the interim general permit. The Draft General Permit and Fact Sheet are available on the NYS DEC website at: http://www.dec.ny.gov/permits/55368.html.
State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
Opportunity for Public Comment: Written statements or comments on the proposed permit renewal will be accepted by fax, email or mail until close of business on January 17, 2014.

Clean Water State Revolving Fund (CWSRF) for Water Pollution Control
Final FFY 2014 Intended Use Plan (IUP) and Final Amendment No. 2 to the FFY 2013 CWSRF Intended Use Plan
The New York State Environmental Facilities Corporation (NYS EFC) and the New York State Department of Environmental Conservation (NYS DEC) have prepared the final Federal Fiscal Year (FFY) 2014 Intended Use Plan (IUP) for the Clean Water State Revolving Fund (CWSRF). The IUP includes a list of projects that may receive financial assistance between October 1, 2013 and September 30, 2014. The final 2014 CWSRF IUP is available to review and download at NYS EFC's website at: www.efc.ny.gov (Click on "Clean Water State Revolving Fund", then "Intended Use Plan and Amendments").
In addition, NYS EFC and NYS DEC announce that Final Amendment No. 2 to the FFY 2013 CWSRF is adopted. This amendment to the FFY 2013 CWSRF IUP presents guidance related to the implementation of the Storm Mitigation Loan Program (SMLP). Additionally, the amendment includes the following changes: A text change to the final IUP, a statement of the final FFY 2013 USEPA Capitalization Grant amount and a statement of availability of a fifth round of Green Innovation Grant Program funding.

Notice of Rescission of Program Policy DER-15, Presumptive/Proven Remedial Technologies
Notice is hereby given that the Division of Environmental Remediation (DER) in the New York State Department of Environmental Conservation (NYS DEC) has rescinded Program Policy DER-15, Presumptive/Proven Remedial Technologies, on December 18, 2013. DER-15 was issued in February 2007 and the information contained in this program policy does not reflect the current best practices for site remediation. Some of the technologies listed have proven to have only limited effectiveness. In order to select an effective remedy for a particular site, it is essential to consider the site geology and other site-specific conditions, so a document that recommends technologies irrespective of those factors has the potential to be misleading. This is only a guidance document and not required by law or regulation. NYS DEC does not believe that this program policy has sufficient value and utility to justify the level of effort that would be needed to revise such a document to be useful and accurate, and then maintain the content as technologies continue to evolve. Program Policy DER-10, Technical Guidance for Site Investigation and Remediation, and NYS DEC Regulations 6 NYCRR Part 375, Environmental Remediation Programs, both define "presumptive remedy" to mean: "technologies or approaches appropriate for the remediation of specific types of contamination which, based on historical patterns of remedy selection and NYS DEC's scientific and engineering evaluation of performance data, can be used to accelerate the remedy selection process." NYS DEC believes that, for the qualified environmental professionals who need to select remedies for sites, this adequately describes a presumptive remedy without need for further guidance.

Notice of Rescission of Technical and Administrative Guidance Memorandum (TAGM) 4051, Early Design Strategy
Notice is hereby given that the Division of Environmental Remediation (DER) in the New York State Department of Environmental Conservation (NYS DEC) has rescinded TAGM 4051, Early Design Strategy on December 18, 2013. TAGM 4051 was rescinded because it is obsolete due to DER's current practices. New Consent Orders include Remedial Design/Remedial Action so there is no need to initiate Consent Order negotiations to amend the Remedial Investigation/Feasibility Study Consent Order before the Record of Decision (ROD) is issued. DER also has a process in place to send referrals to NYS DEC Office of General Counsel once a State-funded project advances to the ROD stage.

NEGATIVE DECLARATIONS
The Town of Plattekill Planning Board, as lead agency, has determined that the proposed Subdivision of MML Homes at Crescent Avenue will not have a significant adverse environmental impact. The action involves a 27 lot residential subdivision situated at Crescent Avenue in the Town of Plattekill and Town of Lloyd, New York. The project is located on 96.23 acres of land in the AG 1.5 Zoning District. A coordinated review has been followed and other involved agencies include the New York State Department of Environmental Conservation (NYS DEC), Ulster County Health Department, Ulster County Public Works Department, Town of Plattekill Town Board, Town of Lloyd Planning Board and the Town of Lloyd Town Board.

The Town of Rosendale, as lead agency, has determined that the proposed Rosendale Water System Improvement Project will not have a significant adverse environmental impact. The action involves the following improvements to the existing water distribution system:
- Installation of 2,600 feet of new 8 inch ductile iron watermain on Main Street, constructed adjacent to existing 6 inch watermain to be abandoned in place;
- Installation of 350 feet of new 8 inch ductile iron watermain on Hattlenburgh Avenue, constructed adjacent to existing 4 inch watermain to be abandoned in place;
- Installation of 300 feet of new 8 inch ductile iron watermain on Snyder Avenue, constructed adjacent to existing 4 inch watermain to be abandoned in place;
- Proposed watermain improvements on Main Street, Hydenburgh Avenue and Snyder Avenue shall include connections to the existing water system and installation of new hydrants, valves, and water services.
The action includes the following improvements to the Town's existing water filtration plant located at the end of John Street:
- Replacement-in-kind of existing four (4) filter trains and process piping;
- Installation of an additional fifth filter train (standby unit) to provide redundancy;
- Expansion of water filtration plant building (additional 2,040 square feet), new Poly Aluminum Chloride chemical metering pump, new raw water pump, new effluent flow meter and modifications to raw water and filter effluent piping to accommodate fifth filter train;
- New master control panel for automation of water filtration plant;
- New computer work station for remote monitoring, control and data logging.
The action includes the following improvements to rehabilitate the 500,000 gallon Sand Hill Water Storage Tank:
- Removal and disposal of existing interior and exterior tank coating systems;
- Installation of new interior and exterior tank coating systems.
The project is located in the Town of Rosendale, New York.
